Terms and Conditions of Use
Each registered user issued with a RedCrest-Probate username and password shall, as a condition of being issued with a username and password, agree to the following terms and conditions of use:
- to comply with Order 1A of the Supreme Court (Administration and Probate) Rules 2023 and Practice Note SC Gen 19 RedCrest and RedCrest-Probate Electronic Case Management Systems;
- to ensure that the issued username and password remain confidential, for the exclusive use of that registered user, or any person duly authorised to lodge on that user’s behalf;
- to comply with any condition or limitation of registration issued in relation to RedCrest-Probate;
- to pay court fees (if any) prescribed by the Supreme Court (Fees) Regulations.

Access to information
Information regarding applications which have been advertised will appear on a database and be made available via RedCrest-Probate which enables individuals to search the deceased’s name to ascertain if a notice of intention to make an application has been published. Data includes, the name of the deceased, their last known address, their date of death, the name(s) of the person(s) intending to make the application and the email address of the person intending to make the application or if they are legally represented, the email address of their legal representative.
Information regarding applications made to the Probate Office of the Supreme Court of Victoria will appear on a database made available on the Court’s website which enables individuals to search the deceased’s name in order to ascertain if an application for a grant of representation has been made. Data includes the name of the deceased, their date of death, the date of application and the status of the application.
Once an application is granted, the grant of representation including the will (if any) will appear on the RedCrest-Probate system. This document will be accessible by persons entering the unique identifier allocated to the application. The applicant will be provided with this identifier so that it can be provided to people who need to verify the applicant’s authority to deal with estate property.
Files may be made available to the public to search on payment of a fee after the application has been granted.
Data and documents for finalised applications are transferred to the Public Records Office of Victoria, generally on an annual basis.
Privacy
The Supreme Court of Victoria collects personal information of RedCrest-Probate users in order to allow them to access the RedCrest-Probate system and to process payments via the system.
If you do not provide this information you may not be able to use, or fully use, the RedCrest-Probate system. The Court may disclose your personal information to third parties who provide it with (or help it provide) products and services (e.g. to financial services providers to process payments and to IT providers to administer and maintain the RedCrest-Probate system), including to overseas locations.
