Probate Office fees will change from 18 November 2024
Changes to the regulations that mandate Probate Office fees have been made and will commence on 18 November 2024. The Supreme Court (Fees) Amendment Regulations 2024 can be viewed on the Victorian Legislation website.
The changes include:
- new estate value brackets and corresponding fees;
- changes to the advertising and small estate fees;
- a new fee for re-advertising an application; and
- a new fee for filing an amended originating motion.
The new estate value brackets and corresponding fees are outlined in the following table:

Why are the Probate Office fees changing?
The Supreme Court of Victoria’s civil fees – including Probate Office fees – are set by government regulations; the Probate Office in the Supreme Court is responsible for collecting those fees in relation to applications made for probate or administration.
The Victorian Government's Department of Justice and Community Safety led a review of fees charged for services provided by the Probate Office within the Supreme Court.
The Court was not a participant in the setting of the new fees, other than providing information to government about the operation of the Probate Office for the purpose of their review.
The Government has released a statement of reasons containing information about the changes to Probate Office fees which outlines the feedback, considerations, and outcome of the Regulatory Impact Statement process that commenced in July 2024.
