Court of Appeal dismisses appeal against sentence.

The Court of Appeal has dismissed an appeal by a violent offender against his sentence on a charge of rape. President Maxwell and Justices Tate and Coghlan found the sentence of a serious sexual offender to eight years' imprisonment, with a cumulation of six years on an earlier sentence of 10 years' imprisonment for three charges of rape, was not manifestly excessive.

The Court also did not find the sentence was more severe than necessary for the protection of the community. The offender, Christos Matheas, is serving a total effective sentence of 16 years' imprisonment with a non parole period of 12 years. The trial judge described the rape of a 17 year old girl as "a terrifying episode of violence."
