Earlier this year, the Common Law Division of the Supreme Court of Victoria invited representatives of the Transport Accident Commission, the Law Institute of Victoria, plaintiff and defendant firms, judicial officers of the County Court and staff to explore and identify initiatives that might improve the management of proceedings for damages in respect of death or personal injury related to a motor vehicle accident.
One of the initiatives resulting from this process is a 'Fast Track' procedure for certain types of these proceedings which will commence on 1 January 2019. The Notice to Profession - Fast Track Pilot - Motor Vehicle Accident Damages Proceedings outlines the eligibility criteria and case management procedures of the pilot.
