The judgment hand down for the matter of Turner v Bayer Australia Ltd & Ors (Essure group proceeding) will be publicly live streamed on 10 December 2024.
 

DETAILS:

The judgment in the matter of Patrice Sarah Turner v Bayer Australia Ltd & Ors will be handed down by the Honourable Justice Andrew Keogh of the Supreme Court of Victoria at 12pm on Tuesday, 10 December 2024.

Turner v Bayer Australia Ltd & Ors (S ECI 2019 02916) is a group proceeding (class action) brought on behalf of persons who have allegedly suffered harm as the result of the implant of a contraceptive device, ‘Essure’, prior to 31 December 2018.

The proceeding is brought against a number of companies alleged to have been involved in the design, development or manufacture of the devices, or to have sponsored the devices under the Therapeutic Goods Act 1989 (Cth).

The plaintiff alleges the defendants breached a duty of care owed to the group members and/or their obligations under Australian consumer protection laws.

The trial ran in the Supreme Court of Victoria from 11 April 2023 to 30 June 2023, and then from 31 July 2023 to 4 August 2023.
