A group proceeding (class action) on behalf of all persons who suffered injury as a result of the mandatory lockdown of nine public housing towers in North Melbourne and Flemington between 4 and 18 July 2020.
On 20 April 2023, the Court approved a Notice of Proposed Settlement to be sent to group members. Group members should read the notice carefully as the matters set out in the notice may affect their legal rights.
The notice requires that group members who wish to partake in the proposed settlement, if approved by the Court, must provide a notice of claim by 27 June 2023.
The notice provides an opportunity for group members to apply to the Court to reinstate group members. Any person who wishes to be reinstated as a group member must submit a completed Reinstatement Application Notice by 15 June 2023
The notice requires that any person who wishes to apply to extend the time by which they may opt-out of the proceeding must submit a completed Opt Out Application Notice by 15 June 2023.
The notice also requires that any group member who wishes to object to the settlement must provide a notice of objection to proposed settlement by 15 June 2023.
