Form 64D is for use in civil proceedings in the Court of Appeal
A party who opposes an application other than for leave to appeal must file a notice of opposition in accordance with Form 64D, together with other required documents. The reasons for opposing the application must be stated briefly but specifically in the form.
Other documents required to be filed at the same time as a Form 64D are:
- Any affidavit relied upon.
- Submissions of no more than 5 pages.
- List of authorities with pinpoint references (note: this is not required if the application is for an extension of time).
- Draft application book index marked-up to show proposed amendments to the draft index filed by the party making the application other than for leave to appeal (note: this is not required if the application is for an extension of time).
