The following types of matters are included in the Commercial and Retail Leases List.
First instance proceedings
The list manages first instance proceedings, within the Court’s jurisdiction, concerning disputes about commercial and retail leases.
The Court’s jurisdiction does not include first instance disputes about leases of retail premises within the meaning of section 4 of the Retail Leases Act 2003 (Vic). Such disputes are within the exclusive jurisdiction of the Victorian Civil and Administrative Tribunal.
Appeals and judicial review applications
The list manages appeals under section 148 of the Victorian Civil and Administrative Tribunal Act 1998 (Vic). It also manages judicial review applications in relation to decisions of the Victorian Civil and Administrative Tribunal concerning commercial and retail lease disputes.
First instance proceedings should be filed in RedCrest in the Commercial Court selecting ‘Commercial Court (Judge Managed)’ in the Case Type field and ‘Commercial and Retail Leases’ in the Initiating Action field.
VCAT appeals and judicial review applications should be filed in RedCrest in the Common Law Division selecting ‘Common Law (Judicial Review and Appeals)’ in the Case Type field and ‘Commercial and Retail Leases’ in the Initiating Action field.
